Understanding Virginia’s Fast Uncontested Divorce Process

The most cost-effective way to get a divorce in Virginia is through an uncontested “fast” divorce. Here is what you need to know about this specific type of divorce, and if you qualify for one.

What is a “Fast Divorce”?

A “fast divorce” is better known as an uncontested divorce. In this specific type of divorce, the spouses already agree on major issues such as asset division, child custody, child support, and spousal support.

If both spouses are not in agreement on the terms of the divorce, or one or multiple issues AND require the court to intervene, it is a contested divorce. This is what most people think of when they hear the word divorce.

If both spouses agree to divorce but disagree on key issues and want to negotiate a settlement, this is also known as an uncontested divorce. This option is more expensive than the “fast divorce”, but significantly cheaper than a contested divorce.

Do I qualify for a Fast Divorce?

Here’s a quick way to determine if you qualify for a fast divorce. Do you and your spouse fully agree on:

  • Asset and property division?
  • Child custody and visitation?
  • Child support?
  • Spousal support?

If you said yes to all four, you qualify for a “fast” divorce. Chances are, you probably said “maybe…” or “no”. If you said no to any of those, you would want to pursue an uncontested or contested divorce.

How long does a Fast Divorce take?

Virginia’s uncontested divorce timeline requires spouses to separate before filing for divorce.

If you have children, the required separation period is one year (12 months). If you do not have any minor children, then you can file for divorce after six months of separation.

After completing the required separation period, you can expect your uncontested divorce matter to be completed in less than a month.

What is an Uncontested Divorce?

An uncontested divorce occurs when you and your spouse are unable to work out all the details (child support, spousal support, assets and property, custody and visitation) and have opted to hire attorneys to settle the matter.

An example: You and your spouse agree to divorce. Both of you agree on child support and child custody but disagree on asset division and spousal support. Neither of you want to go to court over these issues and have hired lawyers to settle the remaining issues.

While this prevents both parties from pursuing the “fast” $599 divorce option, an uncontested divorce or settlement agreement costs significantly less than a contested divorce.

Can an Uncontested Divorce become Contested?

An uncontested divorce can become contested if your spouse no longer agrees with the terms of the divorce, such as grounds for divorce, agreements on child support, spousal support, property division or child custody and visitation.

For example: You and your spouse have been separated for 10 months. With two months left until you can file for divorce, your spouse is now asking for spousal support and disagrees with the proposed custody schedule. Your spouse has hired a lawyer and intends to take the matter to court. The case is now a contested divorce.

If this happens, your matter may be converted to a contested divorce and require a larger retainer. In most cases, the total cost for a contested divorce will range between $15,000 to $30,000 or more, depending on case complexity and other factors which can be discussed with our attorneys.

Does my spouse have to sign anything?

Under specific circumstances, an uncontested divorce can be obtained without your ex’s signature. This is called “Divorce by Publication” and our lawyers are prepared to assist with this process if necessary.
