What Is a No Fault Divorce?

A no-fault divorce is a type of divorce in which the spouse who files for divorce will not have to prove any fault on the part of the other spouse. The most common ground for a no-fault divorce in Virginia is “living separate and apart for six months” (if you have a Settlement Agreement and no minor children”) or “living separate and apart for one year without a settlement agreement”).
