The Uncontested Divorce Process

Step 1: Filing the Complaint

The first step in the uncontested divorce process is filing a Complaint for Divorce. Even if both spouses agree to the divorce, one party must file the Complaint with the court, stating the grounds for divorce. In Virginia, the grounds for an uncontested divorce include living separate and apart for six months if there are no minor children or one year if there are minor children.

Step 2: Proof of Service

Next, the filing party must serve the Complaint to the other spouse. The other party will then accept service by signing the Complaint before a notary public or through their attorney. This step affirms that both parties are aware of the divorce proceedings.

Step 3: Response and Waiver

The receiving party will then need to file a response to the petition or waive further process for an uncontested case. This helps expedite the divorce, as both parties agree on the terms.

Step 4: Finalizing the Divorce

If both parties agree on all issues, the attorneys will draft a settlement agreement and the Final Order of Divorce. The divorce is finalized once submitted to the court and approved by the judge. This marks the official end of the marriage and outlines the division of property, custody arrangements, and support obligations.
