What are the Requirements for Divorce?

The divorce requirements in the Commonwealth of Virginia depend on whether you choose a fault or no-fault divorce. For a no-fault divorce, you must have lived in the state for the last six months. Also, you and your spouse must have lived separately and apart from each other for at least one year prior to the divorce. With no minor children, this requirement is reduced to six months of living separately. 

The Commonwealth of Virginia also allows fault-based divorces, in which you must prove one of the following:

  • Your spouse has committed adultery.
  • Your spouse has caused you to reasonably fear bodily harm.
  • Your spouse has a felony conviction that resulted in a prison sentence.
  • Your spouse willfully deserted or abandoned you.
