Child Custody Attorneys Fairfax

Divorces are complex. They encompass many elements. If there are children involved, then child custody may be a contentious issue.

In most child custody cases, the two issues that arise are who will have primary physical custody and how visitation will occur. Visitation transportation is frequently divided between the parties, but this is not always the case. In visitation cases, the frequency of the visitation and the holiday schedules are some of the most difficult for most parties to resolve by agreement.

In child custody cases, it is best for the parents to come to an agreement on their own. Unfortunately, though, this does not always happen. Parents often have a hard time making decisions together, which may be a cause of divorce in the first place. When an agreement cannot be reached, the court will be forced to make a decision.

You need the right legal help on your side to get a favorable outcome. The Fairfax child custody attorneys at Virginia Family Law Center will look at your desires and your child’s best interests to come up with the best custody solution.

Types of Child Custody

There are two main types of child custody: physical and legal. Physical custody is the type that most people are familiar with. Physical custody refers to how your children split their time between both parents. This includes custody and visitation time.

Physical custody can also be either sole or joint/ Joint custody is more common. Sole custody is rare; the court would need a compelling reason to keep a parent away from their children, such as abuse or neglect. It is more common for one parent to become the primary custodial parent while the other parent has a visitation schedule. However, both parents can split their time with the children however they want, as long as they both agree to the schedule.

If you and the other parent cannot come to an agreement, then the court will be forced to decide based on the best interests of the child. This includes factors such as each party’s age, mental health, physical health, and the relationship between the parent and child.

The other type of custody is legal custody. This refers to making important life decisions for your children. These decisions include your children’s education, medical needs and health care, religion, and extracurricular activities. Again, legal custody can be sole or joint, although it is more commonly joint.
